Validity of Appeal Against Faraday Township’s Decision to Approve Proposed Freymond Quarry Discussed During LPAT Hearing

Representatives and residents met once again to discuss the proposed Freymond quarry at the Faraday Community Centre.

They were joined by Local Planning Appeal Tribunal member Thomas Hodgins who was there to consider the appeal that has been brought forward by Faraday Township to dismiss No Place for a Quarry’s appeal on their decision to approve the proposed quarry. He made sure to note before the meeting that this was not a hearing to discuss the merits of the zoning by-law or to get organized for such a hearing.

Faraday was represented by their lawyer Jennifer Savini who argued that because No Place for a Quarry was not incorporated by February 6th, 2019 when the Township made their decision to approve the proposed quarry, their appeal is invalid. She noted that No Place for a Quarry became incorporated the next day.

Savini called the appeal “frivolous.”

No Place for a Quarry’s lawyer Ian Flett argued that officers of the now-incorporated group spoke as individuals during the public meetings, so it would be unfair to dismiss the appeal on the grounds of them not being incorporated at that time. He said that with the interest the community has in the proposed quarry proves that this appeal is not frivolous.

Hodgins did not make a decision on whether or not the appeal will be dismissed. He will look over more material in the coming weeks and make his written decision at a later date. “I take my decision very seriously,” he said at the end of the meeting.
